TRADEMARK GUIDE

International trademark routes: national, regional and Madrid

Compare direct national filings, regional rights and the Madrid System, including searches, examination and portfolio maintenance.

In short: there is no single trademark certificate that automatically protects a brand worldwide. Overseas protection generally relies on national filings, regional systems, or designations under the Madrid System.

Three common routes

National filing

An application is filed directly with the relevant national office. This can suit a small number of priority markets or a strategy that needs to be tailored closely to local law.

Regional rights

Some regions offer a unitary application, such as the European Union trade mark. Broader coverage can be efficient, but earlier-right and use considerations should be reviewed.

Madrid System

The applicant must already have, or have applied for, a basic mark through an IP office of a Madrid member. WIPO performs formal examination and records the international registration. Each designated member still decides protection under its domestic law.

A clearance review should consider identical and similar words, sounds, meanings and devices, as well as related goods and services. WIPO recommends searching both international and national or regional registers before filing.

A practical preparation sequence

  1. Confirm the correct owner.
  2. Map sales, manufacturing, platform and investment markets.
  3. Prioritise commercially relevant goods and services.
  4. Review word, device and composite versions of the mark.
  5. Compare filing, professional and long-term maintenance costs.

Office actions and disputes

An office may raise distinctiveness, descriptiveness, earlier-right or specification objections. The response and deadline depend on local rules and should be assessed against the actual official notice.

After registration

Maintain evidence of use, ownership records, licences, renewal dates and territorial plans. International portfolio management is an ongoing process.
